Distance Sales Agreement

1. PARTIES

This Agreement has been established between the following parties within the framework of the terms and conditions set below.

  • SELLER: HİVA TASARIM DERİ MAMULLERİ İTHALAT İHRACAT SAN. VE TİC. LTD. ŞTİ.

By accepting this agreement, the BUYER acknowledges and agrees in advance that upon confirming the order subject to this contract, they are obligated to pay the order amount along with any specified additional fees such as shipping costs and taxes.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the terms written below shall have the meanings ascribed to them.

  • MINISTER: The Minister of Trade,
  • MINISTRY: The Ministry of Trade,
  • LAW: Law No. 6502 on the Protection of Consumers,
  • REGULATION: Distance Contracts Regulation,
  • SERVICE: Any consumer transaction other than providing goods, performed or promised to be performed in return for a fee or benefit,
  • SELLER: The natural or legal person acting on behalf of or for the account of the person offering goods to the consumer within the scope of commercial or professional activities,
  • BUYER: The natural or legal person acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes,
  • SITE: The website belonging to the SELLER,
  • ORDERING PARTY: The natural or legal person requesting a good or service via the SELLER's website,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This contract established between the SELLER and the BUYER,
  • GOODS: Refers to movable property subject to shopping and software, sound, image, and similar intangible goods prepared for use in an electronic environment.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation regarding the sale and delivery of the product with specified qualifications and sales price, which the BUYER ordered electronically via the SELLER's website. The prices listed and announced on the site are the sales prices. Advertised prices and promises are valid until they are updated and changed. Prices announced periodically are valid until the end of the specified period.

7. INFORMATION ON PRODUCT(S) SUBJECT TO THE AGREEMENT

7.1. Basic Characteristics: The basic characteristics of the goods, products, or services; including type, quantity, brand/model, color, and number, are published on the SELLER's website. If a campaign is organized by the SELLER, the basic features of the relevant product can be reviewed during the campaign.

7.2. Prices: The prices listed and announced on the site are the sales prices. Advertised prices and promises are valid until updated or changed. Periodically announced prices are valid until the end of the specified period.

7.3. Taxes and Payments: The sales price of the goods or services subject to the contract, including all taxes, is shown in detail on the payment screen.

8. INVOICE INFORMATION

The invoice will be delivered to the invoice address along with the order during delivery or sent as an electronic invoice (e-invoice) to the registered e-mail address in the system.

9. GENERAL PROVISIONS

9.1. Information and Acceptance: The BUYER accepts, declares, and undertakes that they have read the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the contract on the SELLER's website, and that they have given the necessary confirmation in the electronic environment.

9.2. Delivery Time: Each product subject to the contract is delivered within the period specified in the preliminary information section on the website, depending on the distance of the BUYER's settlement, provided it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

If the distance contract is related to the sale of goods, the BUYER may exercise the right to withdraw from the contract by rejecting the goods without any legal or penal liability and without stating any reason, provided that they notify the SELLER within 14 days from the date of delivery of the product to themselves or the person/organization at the indicated address.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for custom-designed or personalized designer leather bags prepared in line with the BUYER's explicit requests or personal needs, nor for products that have been used, damaged, or have lost their resaleability. Other goods and service exceptions specified in the applicable legislation are reserved.

12. STATE OF DEFAULT AND LEGAL CONSEQUENCES

In the event that the BUYER defaults in transactions made by credit card, the BUYER accepts, declares, and undertakes to pay interest within the framework of the credit card agreement between them and the cardholder bank and to be liable to the bank.

13. AUTHORIZED JURISDICTIONS

In consumer disputes arising from this agreement, applications can be made to the competent consumer arbitration committees or consumer courts in accordance with current legislation.

14. EFFECTIVENESS

The BUYER is deemed to have accepted all the terms of this contract when they make the payment for the order placed through the Site.
